Etaerc provides AI-powered digital services including, but not limited to:

All services are delivered on a per-project or subscription basis, as agreed upon in writing.
3. User Responsibilities
By using our services, you agree to:

Provide accurate and complete information

Use our platforms and tools legally and ethically

Not copy, resell, reverse-engineer, or misuse any part of our software or IP

Respect our team and communication guidelines during collaboration
4. Payments and Refunds

Pricing is quoted in South African Rands (ZAR) unless otherwise stated.

Payment terms are agreed prior to project kickoff (e.g., 50% deposit, 50% on completion).

Subscriptions are billed monthly or annually via secure payment gateways (e.g., Stripe, Paystack).

Refunds are assessed case-by-case. Once AI systems or deliverables are deployed, refunds may not be available.
5. Intellectual Property
All AI-generated content, brand assets, automations, and code developed for the client will be transferred upon full payment. However:

Etaerc retains the right to reuse frameworks, prompts, or backend models for other projects.

Clients may not resell or white-label Etaerc tools without written agreement.
6. Limitation of Liability
Etaerc will not be held liable for:

Any indirect, incidental, or consequential losses

Client misuse of AI tools or third-party integrations
-
Technical disruptions due to third-party platforms (e.g., OpenAI, WhatsApp Business API)

Business decisions made based on AI outputs or automation
We will, however, work to correct any faults or errors related to our deployment.
7. Privacy & Data
We comply with the Protection of Personal Information Act (POPIA). Any personal or business data collected is handled securely and responsibly. Read our full Privacy Policy here.
8. Service Availability & Updates
We strive for 99.9% uptime but cannot guarantee uninterrupted access due to updates, maintenance, or third-party service issues.
Etaerc may update service features, pricing, or technical infrastructure at any time. Material changes will be communicated to active users.
9. Termination
We reserve the right to terminate or suspend services for clients who:

Fail to pay invoices after multiple reminders

Engage in abusive, fraudulent, or unlawful behavior

Violate these Terms & Conditions
Clients may cancel a subscription at any time via written notice.
10. Dispute Resolution
Any disputes will first be resolved in good faith through mediation. If unresolved, matters will be handled under the laws of South Africa, with Pretoria as the agreed jurisdiction.
